# Texas recovery path

Checked September 24, 2026. Texas resident/personal telephone scope. Research assessment, not an adjudication; private evidence and case-specific facts remain in ignored storage.

## What the statutes support

**Chapter 305 is not a reliable single-text workaround.** Section 305.053 provides $500 per proven violation or greater actual damages, with discretionary enhancement to $1,500 or three times actual damages for knowing/intentional violations. The underlying violation still matters. Section 305.001 separately requires a charge for the specific mobile call; an ordinary monthly plan does not by itself prove that condition. [Chapter 305](https://tcss.legis.texas.gov/resources/bc/htm/bc.305.htm).

In *Pinn v. CycleBar Franchising, LLC*, No. 3:23-cv-01540-M (N.D. Tex. Dec. 4, 2023), a registered consumer alleged one promotional text under §305.053. The court dismissed because the incorporated federal DNC private-action requirement was more than one violating communication within twelve months. This district-court decision is persuasive adverse authority, not a controlling statewide appellate holding. It directly undermines the earlier suggestion that §305.053 readily bypasses the federal threshold. [Order, pages 3–5](https://cases.justia.com/federal/district-courts/texas/txndce/3:2023cv01540/378887/16/0.pdf).

The federal equipment/voice theory under §227(b) has different elements and does not share that threshold. A bulk-looking SMS does not establish covered equipment. No such equipment evidence has been established here. [47 U.S.C. §227](https://www.law.cornell.edu/uscode/text/47/227).

**Chapter 302 is a separate registration inquiry.** Text solicitations are covered by the current definition. Investigate seller identity, registration, and exemptions before alleging a violation. Section 302.059(1) exempts certain solicitations arranging a later face-to-face presentation, with additional conditions concerning acceptance and immediate collection/delivery. A home-service quote may raise this defense; it does not establish the exemption. Section 302.303 supplies a DTPA enforcement route. Do not present §302.302's $5,000 civil-penalty ceiling as an automatic payment to the recipient. [Chapter 302](https://tcss.legis.texas.gov/resources/bc/htm/bc.302.htm).

**Chapter 304 has separate prerequisites.** Section 304.257 concerns second/subsequent violations and requires notifying the telemarketer, a verified agency complaint within 30 days of the call, and no agency enforcement initiated before day 121 after complaint filing. It permits up to $500 per violation if knowing/willful. Confirm historical Texas-list inclusion and the §304.052 publication period; federal enrollment plus an out-of-state area code does not resolve that evidence question. [Chapter 304](https://tcss.legis.texas.gov/resources/BC/htm/BC.304.htm).

**The 2025 amendment is relevant but not a guaranteed shortcut.** SB 140 applies to conduct from September 1, 2025, adds DTPA enforcement provisions, expands Chapter 302's text definition, and protects repeat claimants from a recovery bar merely because of prior recoveries. It does not amend §305.053 or expressly eliminate existing thresholds. Whether a particular new DTPA theory succeeds requires additional precedent and pleading review. [Enrolled SB 140](https://capitol.texas.gov/tlodocs/89R/billtext/html/SB00140F.htm).

DTPA enforcement requires examination of standing, any consumer-status requirement under the asserted tie-in, causation and recoverable injury. Section 17.50(h) addresses actual damages under another statute's grant of a DTPA action. Section 17.505 generally requires a detailed written damages notice at least 60 days before suit, subject to exceptions. Section 17.565 generally sets two years, with discovery provisions; do not apply the federal limitation period indiscriminately. No final claim deadline has been calculated. [Chapter 17](https://tcss.legis.texas.gov/resources/BC/htm/BC.17.htm).

## What the recipient needs to provide

1. Complete two-way conversations with sender number and actual calendar dates/times, including outgoing replies, opt-outs and later contacts. Preserve originals. A screenshot saying “Today” needs its calendar date established.
2. Confirmation that messages reached the registered number, plus a carrier record showing ownership/control near the contact date. Redact unrelated billing information. Preserve the registry email separately.
3. Where the recipient was when each contact arrived and relevant Texas residence dates.
4. A truthful relationship history: prior purchases, quote requests or lead forms involving the seller, if any. A recorded denial of authorization should not be replaced by repeated guesses about consent.
5. Actual consequences, if any: interruption, privacy intrusion, specific charges or measurable loss. Record what happened without manufacturing a dollar value. Statutory damages and actual-damages theories differ.

Research/preparation can handle the timeline, public business records, registered agent, registration/exemption analysis, legal sources, exhibit index and proposed demand. A claimed business name is an attribution lead, not yet a verified legal defendant. Similar first names or services do not establish common authorship.

## How payment would occur

First assemble a viable claim against an identifiable business. Then obtain focused consumer/TCPA counsel review of the contact count, state theories and remedy before spending on litigation. This is a recommendation, not a legal requirement to retain counsel.

If supported, prepare a factual settlement demand and any applicable presuit notice for approval. Payment may follow a negotiated settlement; otherwise litigation requires the correct defendant, court, venue, service, evidence and a favorable result. A judgment still may require collection. A regulatory complaint is not a personal payment application. Avoid double-counting the same injury under state and federal labels.

For budgeting only, Travis County's 2026 JP schedule lists $54 filing plus $90 service for one party, totaling $144. Other service arrangements, parties, lawyers, appeals and collection can change the cost. No precinct or court has been selected. [Official fee schedule](https://www.traviscountytx.gov/images/justices_of_peace/Doc/2026_JP_Civil_Fee_Schedule.pdf).

Do not wait for, encourage, or solicit additional unwanted contact to enlarge a claim. Review existing history now, preserve evidence, and honor the recipient's desire to stop messages. An opt-out does not itself establish a monetary entitlement.

## Remaining limits

No exhaustive citator or current docket review, no resolved post-SB-140 DTPA theory, no defendant verification or collection assessment, and no court-ready damages calculation. Review exact contact dates immediately for the Chapter 304 complaint window. Nothing has been sent, filed, signed or paid through this research.
