## Finding

This is worth a bounded pilot. The plausible advantage is reducing the cost of assembling accurate cases against identifiable, reachable businesses. The bottlenecks are proof of liability, attribution, service, defenses, and collection—not letter generation. No recovery estimate is supportable from the material inspected so far.

James reports long-standing federal registry enrollment and daily unsolicited contacts. These are user-reported facts, not yet independently verified. A subsequent intake response establishes the Texas research scope; personal-use and approximate tenure details are recorded privately. Exact residence/ownership dates, documentary proof, consent history, complete contacts, and defendants remain unresolved. See the [Texas supplement](texas-supplement.md).

## Federal routes: keep them separate

| Route | What matters | Damages and caution |
|---|---|---|
| TCPA §227(b), equipment/voice restrictions | Covered calls/texts, applicable dialing technology or artificial/prerecorded voice, line type, consent and exemptions | §227(b)(3) provides actual monetary loss or $500 per violation, whichever is greater; a court may enhance for knowing/willful violations. |
| TCPA §227(c), do-not-call regulations | More than one violating call within 12 months by/on behalf of the same entity; applicable residential/wireless protections; permission, relationship, and defenses | §227(c)(5) provides actual loss or up to $500 per violation, whichever is greater, with discretionary enhancement for knowing/willful violations. The statute includes a reasonable-procedures affirmative defense. |

Enhancement can reach three times the statutory amount: commonly the advertised $1,500. It is not automatic. Do not multiply all unwanted contacts by $1,500, assume all rule defects stack, or confuse agency penalties with money payable to James. [47 U.S.C. §227(b)(3), (c)(5)](https://www.law.cornell.edu/uscode/text/47/227).

### Regulatory screening

The FCC's wireless provision expressly covers telemarketing calls and texts. DNC rules include written-permission and established-business-relationship exceptions. The relationship definition generally looks to transactions within 18 months or inquiries/applications within three months; a seller-specific DNC request terminates that relationship exception. Registry screening uses a 31-day update window. The applicable provisions include timing and opt-out duties. Evaluate the exact rule and effective date; do not treat every message after STOP as immediately compensable. [47 C.F.R. §64.1200(c)–(f)](https://www.law.cornell.edu/cfr/text/47/64.1200).

Political, charitable, survey, transactional, and debt-related messages must be screened separately from marketing. A DNC exemption does not establish that every possible method of contacting someone is lawful. A company's claim that James subscribed is evidence to investigate, not proof that valid consent existed. Unknown Senders is an inbox category, not a legal classification. ## Changes that invalidate simplistic playbooks

- **Facebook v. Duguid (2021):** ATDS analysis turns on random/sequential number-generator requirements. A templated or bulk-looking text does not prove use of a statutory autodialer. This does not eliminate distinct DNC or artificial/prerecorded-voice theories. [Supreme Court opinion](https://www.supremecourt.gov/opinions/20pdf/19-511_p86b.pdf).
- **Insurance Marketing Coalition v. FCC (2025):** the Eleventh Circuit vacated the challenged one-to-one and logically/topically related consent restrictions. Do not build a claim on the assumption that the proposed 2025 one-to-one rule became enforceable. The decision is not blanket permission for all lead-generation contacts. [Opinion, January 24, 2025](https://media.ca11.uscourts.gov/opinions/pub/files/202410277.pdf).
- **McLaughlin Chiropractic v. McKesson (2025):** district courts in civil enforcement proceedings are not bound by an agency's statutory interpretation under the Hobbs Act. Applicable precedent and statutory interpretation matter; an FCC summary alone is not a litigation guarantee. [Supreme Court opinion, June 20, 2025](https://www.supremecourt.gov/opinions/24pdf/23-1226_1a72.pdf).
- **Consent revocation (2026):** DA 26-12 extends the waiver for treating an opt-out from one informational subject as revoking unrelated robocalls/texts from that caller until January 31, 2027. This is a specific cross-topic scope issue, not a blanket suspension of opt-out duties. The official search index supplied paragraph 1; direct PDF retrieval returned 403. Obtain and archive the full order and any subsequent changes before encoding this rule. [FCC DA 26-12](https://docs.fcc.gov/public/attachments/DA-26-12A1.pdf).

This is a researched snapshot, not an exhaustive case-law citator or assurance that no later authority exists. Historical contacts require historical rules; the current regulation alone is insufficient.

## Where automation stops helping by itself

1. **Attribution:** displayed numbers and a business name can be spoofed. A local area code does not prove a local business sent the communication. Separately establish sender, seller, vendor/agency relationship, legal entity, registered agent, and service address. Public registry listings prove entity details, not authorship.
2. **Consent and defenses:** preserve James's outgoing texts, purchases, inquiries, account signups, opt-ins and revocations. Record uncertain recollections as uncertain. Review arbitration terms, releases, prior settlements, and any contrary evidence rather than omitting it.
3. **Jurisdiction and deadlines:** confirm state/county, receiving-number use, where contacts were received, court jurisdiction, venue, service, standing/injury, and relevant state statutes. Business or mixed-use numbers require specific analysis. The federal catchall provides four years for qualifying federal claims, but do not calculate a final filing deadline without reviewing accrual, claim type, and applicable authority. Agency reports and demand letters should not be assumed to toll time. [28 U.S.C. §1658](https://www.law.cornell.edu/uscode/text/28/1658).
4. **Collection:** a judgment or settlement promise is not cash. Unknown offshore scammers may be poor recovery candidates even with extensive evidence. Keep collection uncertainty separate from legal merits.
5. **Procedure:** small claims may be economical for some matters, but court limits, available relief, fees, service, representation rules, arbitration, and removal must be assessed locally. No court or filing form has been selected.

Before external escalation, a licensed TCPA/consumer lawyer in the relevant jurisdiction should review the pilot's best packet, the private right of action for each theory, damages counting, and cost exposure. This is a recommended quality gate for this design, not a claim that counsel is legally mandatory for all self-represented cases.

## Reports versus compensation

FCC unwanted-call complaints contribute to enforcement; the FCC says it does not resolve individual TCPA complaints. Reporting is not a personal damages award. Preserve evidence before using platform spam-reporting flows that may remove messages. [FCC complaint FAQ](https://consumercomplaints.fcc.gov/hc/en-us/articles/205082880-Filing-a-Complaint-Questions-and-Answers).

The FTC explains how to verify registration and the registry's exceptions. Obtain verification for the exact number, preserving the returned registration date and the verification date separately; a current verification is not proof of uninterrupted ownership since original enrollment. [FTC registry FAQ](https://consumer.ftc.gov/articles/national-do-not-call-registry-faqs).

## Reuse decisions

| Existing resource | Decision |
|---|---|
| Apple's Messages UI | Use for narrow source comparison and screenshots. Filtering is a discovery aid. Do not mark senders known or change/delete evidence merely to inspect links. |
| ReagentX/imessage-exporter | Preferred extraction candidate: existing read-only exporter with portable text/HTML and attachment support. Pin a tested release; inspect current flags and diagnostics. It is a technical export, not court-certified authentication. [Repository](https://github.com/ReagentX/imessage-exporter), [usage](https://github.com/ReagentX/imessage-exporter/blob/develop/imessage-exporter/README.md). |
| FCC/FTC portals | Reuse official reporting channels if later authorized; do not build a submission bot during the pilot. |
| Consumer/TCPA attorney | Preferred legal review and possible recovery partner. No firm selected, contacted, or fee arrangement assumed. |
| General “robot lawyer” services | No recommendation or purchase. FTC's DoNotPay action illustrates why marketing claims about replacing lawyers are insufficient validation. [FTC case record](https://search.ftc.gov/legal-library/browse/cases-proceedings/donotpay). |

Build only the small integration layer specific to James's evidence, review state, and outcomes; no public tool can establish his consent history or validate these particular defendants from inbox labels alone. Start with the provided templates. A custom app is justified only if the pilot exposes recurring clerical work.

## Research still required after intake

- State statutes and private remedies, current local/federal precedent, residential status of this number, and standing.
- Private enforceability of the precise regulation asserted, historical text-message coverage, transport-specific treatment (SMS/MMS/RCS/iMessage), damages overlap, and defenses.
- Exact opt-out timelines and waiver scope on each contact date; full archived DA 26-12 and later developments.
- Court forms, filing/service costs, limitations deadlines, arbitration, fee/cost exposure, and collection procedure.
- Defendant-specific provenance and collectability. Do not use a reverse-lookup guess as the defendant.
